1. Service Description

Qu-Chat is a decentralized, quantum-resistant messaging platform that enables users to communicate securely using end-to-end encryption. The service is provided "as is" and is currently in active development.

Important: Qu-Chat is experimental software that has not yet undergone a professional security audit. While we use NIST-approved cryptography and implement security best practices, you use this service at your own risk.

2. User Responsibilities

2.1 Acceptable Use

You agree to use Qu-Chat only for lawful purposes. You must not:

• Use the service to transmit illegal content
• Harass, threaten, or harm others
• Impersonate others or create fake identities
• Attempt to hack, disrupt, or damage the service
• Spam or send unsolicited messages
• Distribute malware or malicious content
• Violate intellectual property rights

2.2 Account Security

You are responsible for:

• Securing your Web3 wallet and private keys
• All activities that occur under your wallet address
• Notifying us of any unauthorized use of your account

Note: We cannot recover lost or stolen private keys. Keep them secure and backed up.

3. Content and Ownership

3.1 Your Content

You retain all rights to the content you create and share on Qu-Chat. By using the service, you grant us a limited license to:

• Transmit your encrypted content through our infrastructure
• Store your encrypted content on the decentralized network

We cannot read your encrypted content and have no rights to it.

3.2 Our Content

The Qu-Chat platform, including its design, features, and branding, is owned by us and protected by copyright and other intellectual property laws.

4. Privacy and Data

Our use of your information is governed by our Privacy Policy. Key points:

• We cannot read your encrypted messages
• We collect minimal data (see Privacy Policy)
• Your messages are stored on a decentralized network
• We do not sell or share your data with third parties

5. Service Availability

We strive to keep Qu-Chat available 24/7, but we do not guarantee uninterrupted access. The service may be temporarily unavailable due to:

• Maintenance and updates
• Technical issues
• Third-party service disruptions (P2P network, IPFS, etc.)
• Force majeure events

6. Disclaimers and Limitations

6.1 No Warranty

Qu-Chat is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Non-infringement
• Security, reliability, or availability
• Freedom from errors or bugs

6.2 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any:

• Indirect, incidental, or consequential damages
• Loss of data, profits, or business opportunities
• Damages resulting from use or inability to use the service
• Unauthorized access to your communications

6.3 Decentralization Disclaimer

Because Qu-Chat uses decentralized infrastructure (P2P network, IPFS), we have limited control over:

• Network availability and performance
• Data persistence and retrieval
• Ability to delete content once distributed

7. Termination

We reserve the right to suspend or terminate your access to Qu-Chat at any time, without notice, for:

• Violation of these Terms of Service
• Illegal or harmful behavior
• Any other reason at our sole discretion

You may stop using Qu-Chat at any time. Your encrypted messages may persist on the decentralized network even after account termination.

8. Changes to Terms

We may modify these Terms of Service at any time. We will notify users of material changes by posting the updated terms on this page. Your continued use of Qu-Chat after changes constitutes acceptance of the new terms.

9. Governing Law

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
